USE WITHOUT AUTHORITY

Use without Authority G.L. c. 90 § 24

The defendant used a Motor Vehicle;

Knowing that it’s use was not authorized by the owner or a person having lawful control.

Penalty

1st offense: Jail up to 30 days and/or fine up to $500.00 not less than $50.00;
2nd offense: State prison up 5 years or imprisonment in the house of correction up to 2 ½years and/or fine up to $1000.00;
3rd offense: if committed within 5 years of the earliest of his/her two most recent prior offenses: state prison up to 5 years or imprisonment in the house of correction not more than 2 ½years or not less than 6 months and/or fine not less than $200.00 or Not more than $1000.00.

Registry and Civil Liability:

1st offense: Minimum revocation 1 year;
2nd offense/subsequent: Minimum revocation 3 years. G.L. c. 90 § 24f holds offenders civilly liable for any towing, storage, and damage to the vehicle.
